Tänasest 13.03.2020 kuulutas valitsus välja seoses COVID-19 levikuga eriolukorra, mis mõjutab ka meie majanduskeskkonda. Allpool mõned praktilised juhised, kuidas sellises olukorras tööd korraldada. Mida teha töötajatega, kui tööd ei ole või tööd ei saa teha?

Kuidas korraldada töö olukorras, kui töötajal ei ole võimalik piirangute tõttu töökohal viibida või oma tööülesandeid täita?

Teatud juhtudel väljastab perearst töötajale töövõimetuslehe. Kui aga töölt eemalejääval töötajal haigussümptomeid ja teadaolevat kokkupuudet nakatanuga ei ole, siis tuleks töötajal ja tööandjal omavahel kokku leppida, kuidas ajutine töökorraldus toimuma hakkab. See põhimõte kehtib olenemata sellest, kas töölt jäädakse eemale töötaja enda või tööandja algatusel.

Ühe lahendusena on pooltel võimalik kokku leppida ajutiselt kaugtöö tegemises. Seejuures tuleb meeles pidada, et tööandja ei saa sundida töötajat kaugtööd tegema ja töötaja ei saa kaugtööd nõuda. Kaugtöö tegemisel lepitakse tavaliselt kokku, kuidas omavahel suheldakse, millised on turvameetmed, kuidas korraldatakse tööohutusnõuete täitmine jne.

Kui kaugtöö tegemine ei ole võimalik või kui üks pooltest sellega ei nõustu, siis võivad tööandja ja töötaja kokku leppida kas tasustamata või tasustatud (lisa)puhkuse andmises. Ühepoolselt tööandja töötajat puhkusele saata ega töötasu maksmata jätta ei saa (v.a TLS § 37 kohaldamisel, vt all). Ka töötajal puudub seaduslik alus nõuda, et tööandja vabastataks ta töötamise kohustusest. Tööandjal ei ole kohustust võimaldada töötajale vaba aega ilma mõjuva põhjuseta, ent olukorras, kus valitsusasutused on väljastanud koju jäämise soovituse, on ühise lahenduse leidmine ilmselt vältimatu.

Mida saab tööandja teha, kui COVID-19 levik ja kehtestatud piirangud kahjustavad ajutiselt tööandja majandustegevust?

Eriolukorra kehtestamine ja sellega seoses paljude ettevõtete tegevuse piiramine kahjustavad ka majandust ning tekitavad tööandjatele raskusi. TLS § 37 lg 1 sätestab, et kui tööandja ei saa ettenägematutest, temast mitteolenevatest majanduslikest asjaoludest tulenevalt anda töötajale kokkulepitud ulatuses tööd, võib ta töötasu kuni kolmeks kuuks 12-kuulise ajavahemiku jooksul vähendada mõistliku ulatuseni, kuid mitte alla Vabariigi Valitsuse kehtestatud töötasu alammäära, kui kokkulepitud töötasu maksmine oleks tööandjale ebamõistlikult koormav. Seega on tööandjatel võimalus töömahu vähenemisel erakorraliselt töötasu ühepoolselt ajutiselt vähendada, kui tööandja võimekus tavapärast töötasu maksta on kahjustatud.

Töötajal on õigus keelduda töö tegemisest võrdeliselt töötasu vähendamisega. See tähendab, et kui tööandja soovib töötasu vähendada 50% võrra, siis ka töömahtu tuleb vähendada samas ulatuses. Eeltoodust hoolimata ei tohi töötasu vähendada alla Vabariigi Valitsuse kehtestatud töötasu alammäära (584  eurot).

Tööandja peab teatama töötasu vähendamisest usaldusisikule ja töötajatele vähemalt 14 kalendripäeva ette.

Töötajal on TLS §-is 37 ette nähtud meetmete rakendamisel õigus tööleping üles öelda, teatades sellest tööandjale viis tööpäeva ette. Kui töötaja on töötasu vähendamise tõttu töösuhte lõpetanud (st TLS § 37 lg 5 alusel), siis tuleb talle maksta hüvitist samas ulatuses, mis koondamisel ehk töötaja ühe kuu tasu ulatuses. Samuti on töötajal õigus saada töötuskindlustushüvitist, kui tööleping on lõppenud sellel alusel.

Today, on March 13, 2020, the Estonian government declared a state of emergency regarding the spread of COVID-19, which will also affect our business environment. Below are some practical guidelines on how to handle this situation with respect of employment arrangements. What to do with employees if there is no work or work cannot be done?

How can work be organized in a situation where the employee is unable to be in the workplace or perform employment duties due to restrictions?

In certain cases, a doctor will issue an employee with a disability certificate. However, if the employee who has to remain at home has no symptoms of illness and no known exposure to the infected person, then the employee and the employer should agree on how the temporary work arrangement will be arranged. This principle applies irrespective of whether the employee remains away from work at the initiative of the employee or the employer.

One solution is for the parties to agree to remote work on a temporary basis. However, it must be remembered that the employer cannot force the employee to do telework and theemployee cannot demand telework. Also, without the agreement of the parties, remuneration conditions must not deteriorate as a result of teleworking. In the agreement for teleworking it is usually agreed on how to communicate with each other, what the security measures are, how employment safety is organized, and so on.

If teleworking is not possible or if one of the parties disagrees, the employer and the employee may agree to provide either unpaid or paid (additional) leave. The employer may not prescribe for vacation or cancel salary payments (except for the purposes of § 37 of the Employment Contracts Act, see below).

There is also no legal basis for an employee to require an employer to be relased from the obligation to work. There is no obligation on the employer to allow the employee time off without good reason, but in a situation where the authorities has issued a recommendation to stay home, finding a common solution is probably inevitable.

What can an employer do if the spread of COVID-19 and the restrictions imposed harm temporarily its economic activity?

Establishing a state of emergency and banning many events and limiting the activities of companies also damage the economy and create difficulties for employers. Section 37 (1) of the Employment Contractts Act provides that if an employer, due to unforeseen economic circumstances beyond its control, fails to provide an employee with work to the agreed extent, the employer may, for up to three months over a period of 12 months, reduce the wages to a reasonable extent, but not below the minimum wage established by the Government of the Republic, if payment of the agreed wages would be unreasonably burdensome for the employer.

Thus, the employers have the possibility of unilaterally reducing the wages by reducing the volume of work if the employer’s ability to pay normal wages is impaired.

The employee has the right to refuse to work in proportion to the reduction in pay. This means that if the employer wants to reduce salary by 50%, the amount of work must be reduced to the same extent. Notwithstanding the foregoing, wages may not be reduced below the minimum wage (EUR 584) established by the Government of the Republic.

The employer shall notify the trustees and employees of the reduction in wages at least 14 calendar days in advance.

The employee shall have the right to terminate the employment contract by giving notice to the employer five working days in advance of the measures provided for in § 37 of the Employment Contractts Act. If the employee has terminated his/her employment due to the reduction of his/her salary, he/she shall be compensated to the same amount as the redundancy, ie the employee’s monthly salary. An employee is also entitled to unemployment benefit if he/she terminates his/her contract of employment on that basis.
